Booking agreement, prices & payment
A booking is confirmed only when How Many Fishing Charters accepts it and any required payment is received. Advertised prices are $220 per person or $800 for the full boat, for a five-hour charter with a maximum of four guests, unless the written booking confirmation says otherwise. No additional person may attend without Kelvin’s prior written consent. Guests must check their confirmation and promptly report any error. Any additional card or booking fee must be disclosed before payment.

Acceptance & digital guest declaration
The booking contact must accept these policies and Kelvin’s charter-day rules when submitting a booking request. Before departure, every guest must complete the individual digital guest declaration confirming that they have read and understood the terms, onboard rules and skipper authority. A parent or guardian must complete the declaration for a guest under 16. A person who does not complete the required declaration may not board.

Customer cancellations & changes
If the customer gives more than 72 hours’ notice, the booking may be moved once to another available date. A customer cancellation within 72 hours of departure, late arrival that prevents the trip, or a no-show is not eligible for a refund or reschedule, except where required by the Australian Consumer Law or where the amount retained would exceed the business’s reasonable loss arising from the cancellation. A substitute guest may be nominated with Kelvin’s prior approval.

Weather, safety & operator cancellations
Safety comes first. Kelvin may delay, shorten, relocate, reschedule or cancel a charter because of unsafe weather, sea conditions, vessel issues, illness, official direction or another operational safety concern. The launch location may change up to 24 hours before departure based on weather and where the hottest bite is. If How Many Fishing Charters cannot provide the booked service, the customer will be offered an appropriate reschedule, credit or refund having regard to the circumstances and rights under the Australian Consumer Law. Reasonable safety or fishing-plan changes are not a guarantee of any particular fishing location or species.

Gift vouchers
Gift vouchers are valid for three years from purchase and will display their expiry date. They may be used toward an eligible charter subject to availability and these booking terms. Vouchers are not redeemable for cash except where required by law. If a booking made with a voucher is rescheduled under these terms, the value will be carried to the approved replacement date.

Safety, health & skipper authority
Every guest must attend the safety briefing, use required safety equipment and immediately follow the skipper’s lawful directions. Tell Kelvin before departure about any medical condition, allergy, mobility need, pregnancy or medication that could affect safe participation. The skipper may refuse boarding or end participation where a person is intoxicated, abusive, unsafe, unwell, unable to comply with directions, or creates a risk to people, property or the vessel. This discretion is exercised for safety and does not remove any non-excludable consumer rights.

Guests under 16, supervision & accessibility
A guest under 16 must be accompanied and actively supervised by a responsible adult. The booking contact must disclose each young guest’s age and any accessibility needs before confirmation so the skipper can assess safe arrangements, suitable safety equipment and vessel limitations. Participation is subject to the vessel’s lawful capacity and safe operating conditions.

Fishing rules & the catch
Every guest who requires a Victorian recreational fishing licence must carry a current licence; guests should check current exemptions before the day. All guests must comply with current Victorian fishing laws, including permitted-equipment, size, bag, possession, protected-species and closed-season rules. Kelvin plans each charter around what is plentiful and the best available bite. A specific species request must be discussed with Kelvin before the day and cannot be guaranteed. The skipper’s decision about measuring, keeping, dispatching or releasing a catch is final aboard the vessel. Guests must not sell catch from a recreational charter.

Equipment, belongings & damage
Rods, reels, tackle and bait are included. Guests may bring suitable personal fishing gear with Kelvin’s prior knowledge and remain responsible for it. Bring only essential bags so the small boat remains clear and comfortable. Bring an esky for retained catch but keep it securely in the car during the charter. Take reasonable care of charter equipment and the vessel. A guest may be asked to meet the reasonable cost of deliberate or negligent damage they cause, subject to applicable law.

Toilet, seasickness & personal preparation
There is no toilet aboard, so guests should use shore facilities before boarding. A guest concerned about motion sickness should ask a doctor or pharmacist which option is suitable and follow the product directions; some medicines may cause drowsiness. Motion-sickness medicines generally work best when taken before symptoms begin. Guests remain responsible for bringing any personal medicine they may need and telling Kelvin about anything relevant to safe participation.

Alcohol, drugs, smoking & conduct
Illegal drugs are prohibited. Adult guests may bring a moderate amount of alcohol, but no glass bottles or containers are permitted. As an onboard charter rule, guests who drink must remain below 0.05 BAC. Intoxication, unsafe conduct or behaviour Kelvin considers unacceptable may result in an early return to shore or removal from participation. Smoking and vaping are not permitted aboard. Guests must behave respectfully and must not harass, threaten or endanger another person.

Risk acknowledgement & legal rights
Boating and fishing involve inherent risks, including changing weather, waves, slippery or moving surfaces, hooks, lines, fish, seasickness and physical injury. Guests must take reasonable care and follow the safety briefing. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. No statement on this website is intended to operate as an unlawful waiver.

Photos & marketing consent
How Many Fishing Charters will ask before using an identifiable guest’s image for advertising or social media. Consent is optional and may be withdrawn for future use by contacting the business. A parent or legal guardian must consent for a child. Guests must also obtain permission before commercially publishing identifiable images of other guests.

Privacy
Booking information is collected to respond to enquiries, administer charters, take payment, manage safety and communicate service updates. Only information reasonably needed for those purposes should be collected. It may be shared with payment, booking, communications, professional or emergency-service providers where reasonably necessary or required by law. Customers may request access, correction or deletion where applicable. Payment-card details should be handled by the chosen secure payment provider, not retained in website messages.

Complaints, law & changes
Raise a concern with How Many Fishing Charters first so it can be considered promptly. These terms are governed by the laws of Victoria, Australia, without limiting any consumer’s rights to use a tribunal, regulator or court available to them. Policies may be updated for legal, safety or operational reasons; the terms supplied and accepted at the time of booking apply unless the law requires otherwise.
